Terms of Service

1. Acceptance of Terms

By accessing or using JinKul (the "Service"), a product of Rushmore Advisors LLC, with paid subscriptions in India billed by EurekAI Solutions (collectively "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time by posting the revised version on this page. Your continued use of the Service after changes constitutes acceptance. We will provide reasonable notice of material changes.

2. Service Description

JinKul is a household meal planning and nutrition management application designed for Indian families. The Service includes:

  • Personalized meal plan generation based on family nutrition needs
  • Nutrition tracking and calorie management for household members
  • Grocery list generation and shopping integration with third-party delivery services
  • Cook portal with daily recipes, ingredient checklists, and preparation instructions
  • WhatsApp notifications for meal plans and cook coordination

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By using JinKul, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Family member profiles for minors may only be created by an adult account holder.

4. User Accounts

You sign in via Google OAuth. You are responsible for maintaining the security of your Google account and for all activities that occur under your JinKul account. You must provide accurate household and family member information for the meal planning features to function correctly.

You agree to:

  • Provide accurate dietary and health information for your household
  • Only provide WhatsApp numbers of individuals who have consented to receive messages
  • Not share your account access with unauthorized third parties
  • Notify us immediately of any unauthorized use of your account

5. Health & Nutrition Disclaimer

IMPORTANT: JinKul provides nutrition information and meal suggestions for general wellness purposes only. This is NOT medical advice.

  • Nutrition calculations are based on the Indian Nutrition Database (INDB 2024) and standard portion sizes. Actual nutrition may vary based on preparation methods, ingredient brands, and serving sizes.
  • JinKul is not a substitute for professional medical or dietary advice. Always consult a qualified doctor, dietitian, or healthcare provider for disease-specific diets (diabetes, hypertension, kidney conditions, etc.).
  • We do not guarantee specific health outcomes from following our meal plans.
  • If you have food allergies, always verify ingredients independently before consumption.

6. Subscriptions & Billing

JinKul is offered as a paid subscription service for Indian households, billed in Indian Rupees (₹) by EurekAI Solutions, GSTIN 27AQOPC2676G1ZO, registered in Mumbai, Maharashtra, India.

a) Plans

  • Monthly plan: ₹299 per month, includes up to 5 family members
  • Annual plan: ₹3,000 per year, includes up to 5 family members (equivalent to two months free)
  • Additional members: ₹100 per month or ₹1,000 per year, per family member beyond the first 5
  • Households with 9 or more members: Please contact us at contactus@rushmoreadvisors.com for manual enablement

b) Free Trial

New households receive a 14-day free trial with full access to all paid features. No charge is made during the trial. At the end of the trial, the subscription you selected will begin billing automatically. You may cancel any time during the trial to avoid charges.

c) Renewal & Member-Count Adjustments

Subscriptions renew automatically at the end of each billing cycle (monthly or annually). Family member count is recalculated at renewal time. If you add or remove members mid-cycle, the change reflects in the next billing cycle, not retroactively for the current period.

d) Plan Switches

You can switch between monthly and annual plans through the Billing Settings page. Plan switches take effect at your next renewal; we do not pro-rate mid-cycle changes.

e) Taxes

All prices are inclusive of applicable GST as per Indian tax law. GST invoices are issued through our payment processor and made available in your billing history.

f) Payment Processor

Payments are processed by Razorpay Software Private Limited, a payment aggregator authorized by the Reserve Bank of India. We do not store your card or bank account information; this data is held securely by Razorpay under PCI-DSS compliance. By subscribing, you also agree to Razorpay's terms of service.

7. Cancellation & Refund Policy

a) How to Cancel

You may cancel your subscription any time through the Billing Settings page in the app (Settings → Billing → Cancel subscription), or by emailing contactus@rushmoreadvisors.com.

b) What Happens After Cancellation

When you cancel, you retain full access to paid features until the end of your current billing period. After that period ends, the subscription will not renew, and the paywall will limit your access to new meal-plan generation. Existing meal plans, the cook portal, and grocery lists you have already created remain accessible in read-only mode.

c) Refund Policy

We do not offer refunds for partially used subscription periods, unused trial days, or for member-count changes mid-cycle. The 14-day free trial is provided so you can evaluate the Service before any charge. Once a billing cycle has begun, the entire cycle is non-refundable.

Exceptional refund requests (duplicate charges, billing errors, service unavailability) will be reviewed case-by-case. Contact contactus@rushmoreadvisors.com within 7 days of the disputed charge with your subscription ID and a description of the issue. Approved refunds are processed to the original payment method within 7–10 business days.

d) Cancelling During the Free Trial

You can cancel during the 14-day free trial at any time. If you cancel before the trial ends, you will not be charged. There is no refund or extension for unused trial days if you cancel before the trial naturally expires.

8. Failed Payments & Account Suspension

If a scheduled subscription payment fails (insufficient funds, expired card, eMandate rejection, etc.), our payment processor will retry the charge up to 3 times over 7 days. During this retry window your access remains active.

If all retry attempts fail, your subscription will be marked as halted. You will receive an email notification asking you to update your payment method. While in halted state, paid features (new meal-plan generation) are suspended; existing data remains accessible.

You can reactivate by updating your payment method through Billing Settings. If you do not reactivate within 30 days of the halted state, the subscription will be permanently cancelled. Your account and data are not deleted; you may resubscribe at any time.

9. Disputes & Chargebacks

If you believe a charge is incorrect, please contact us at contactus@rushmoreadvisors.com before initiating a chargeback with your bank. Most disputes (duplicate charges, wrong plan, member-count errors) can be resolved within 2–3 business days through direct communication.

Initiating a chargeback without first contacting us may result in immediate suspension of your account while the dispute is investigated. Chargebacks made in bad faith — for charges that were correctly authorized — may result in permanent account termination and recovery of incurred chargeback fees.

For payment disputes that cannot be resolved through customer support, you may also contact Razorpay's grievance officer (per Indian Payment Aggregator regulations) or escalate to the Banking Ombudsman as applicable under RBI guidelines.

10. Third-Party Integrations

JinKul integrates with third-party services to enhance functionality:

  • Google: Authentication and sign-in
  • Swiggy Instamart: Grocery product search, cart management, and order fulfillment
  • WhatsApp (Meta): Meal plan and cook notifications
  • Razorpay: Payment processing for subscriptions

These integrations are subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or performance of third-party services. Grocery prices, product availability, and delivery times are determined by the third-party provider.

11. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract source code from the application
  • Scrape, data-mine, or systematically extract data from the Service
  • Impersonate another person or entity
  • Interfere with the operation of the Service or impose unreasonable load on our infrastructure
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Resell or redistribute the Service or its data

12. Intellectual Property

All content, features, and functionality of JinKul — including but not limited to the meal planning algorithms, dish database, nutrition calculations, user interface design, and branding — are owned by Rushmore Advisors LLC and protected by intellectual property laws.

You retain ownership of your personal data (household information, preferences, notes). By using the Service, you grant us a limited license to process your data solely for providing and improving the Service.

13. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUSHMORE ADVISORS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO HEALTH OUTCOMES, GROCERY ORDER ISSUES, OR THIRD-PARTY SERVICE FAILURES.

14. Termination

You may delete your account at any time through the app settings. Upon deletion, all your personal data will be permanently removed within 30 days.

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. We will provide notice where practicable.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

For users outside India, you agree that any claim or dispute shall be resolved under Indian law and in Indian courts, to the extent permitted by your local law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Rushmore Advisors LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
